I have had a long drawn out issue with my 2010 Subaru Forester 2.0-litre diesel that I bought new. Since buying it I have had to take it back to the dealer several times with a number of problems. There were missing screws from the dashboard, the steering wheel controls were faulty, there were issues with the DPF, the clutch has been replaced twice, the hill-start was faulty and there were turbo problems. I have had three years of constant problems with this vehicle, so I sent a letter of demand to Subaru Australia requesting a replacement vehicle given the major faults with the vehicle. I then received a call from Subaru Australia where they said given the information received from the dealer the issues were caused by the manner in which it was driven and not manufacturing faults. I have contacted the Office of Fair Trading and requested its assistance.
We don't actually have 'Lemon' laws as such in Australia, so asking for your money back is problematic, particularly if the dealer and the carmaker is attempting to fix your car. Obviously your problem has escalated to the point you have called in the Office of Fair Trading to adjudicate, and that would seem to be the best course of action in this case.
